Terms of Service

These Terms of Service ("Terms") govern your use of cadence. (cadence.alen.world), operated by Alen Damadzic ("we", "us", "our"). By creating an account or using cadence., you agree to these Terms.

1. Acceptance of Terms

By accessing or using cadence., you confirm that you are at least 16 years old, have the legal capacity to enter into a binding agreement, and agree to be bound by these Terms and our Privacy Policy.

If you are using cadence. on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

cadence. is a project and portfolio management platform based on phase-gate methodology. We offer three tiers: Free, Pro, and Enterprise. Features and limits vary by plan as described on our Pricing page.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Account Registration

You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials.

You must notify us immediately at cadence@alen.world if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your account. One person or entity may not maintain more than one Free account.

4. Acceptable Use

You agree not to:

  • Use cadence. for any unlawful purpose or in violation of applicable law
  • Attempt to gain unauthorized access to any system, account, or data
  • Transmit viruses, malware, or other malicious code
  • Scrape, crawl, or extract data from cadence. without our written permission
  • Reverse engineer or decompile any part of cadence.
  • Resell, sublicense, or commercially exploit cadence. without authorization
  • Use cadence. to transmit spam, harassment, or harmful content
  • Impersonate another person or entity

We reserve the right to suspend or terminate accounts that violate these rules.

5. Your Content

You retain full ownership of all content you create in cadence., including projects, tasks, phases, and any files uploaded.

By using cadence., you grant us a limited, non-exclusive license to store, display, and process your content solely for the purpose of providing the service. We do not claim ownership of your content. We do not use your content to train AI models or share it with third parties except as described in our Privacy Policy.

You are responsible for ensuring your content does not infringe on the rights of others.

6. Subscription and Payment

  • Free accounts: available at no cost with feature and project limits as described on the Pricing page.
  • Paid plans: billed monthly or annually as selected at checkout. Payments are processed by Stripe. By subscribing, you authorize recurring charges to your payment method.
  • Upgrades take effect immediately. Downgrades take effect at the end of the current billing period.
  • Refunds: we offer a 14-day refund on first-time Pro subscriptions if cadence. does not meet your needs. Contact cadence@alen.world to request a refund.
  • We reserve the right to change our prices with 30 days' notice. Continued use after price changes constitutes acceptance.

7. Cancellation and Termination

You may cancel your account at any time from your account settings. Upon cancellation, your access to paid features ends at the close of the current billing period.

We may suspend or terminate your account for violation of these Terms, non-payment, or for any reason with 30 days' notice (or immediately for serious violations). Upon termination, you may export your data. We will delete your data within 30 days of account closure as described in our Privacy Policy.

8. Intellectual Property

cadence. and all underlying technology, design, and content are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our platform, branding, or code without written permission.

The cadence. name, logo, and brand identity are our trademarks. You may not use them without prior written consent.

9. Disclaimers

cadence. is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that cadence. will be uninterrupted, error-free, or completely secure. We are not responsible for data loss caused by technical failures, though we maintain backups and work diligently to prevent such events.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claims arising from your use of cadence. shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) €100.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption. Some jurisdictions do not allow limitation of liability for certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted.

11. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses (including legal fees) arising from your use of cadence., your content, or your violation of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Slovenia, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of cadence. will be resolved through binding arbitration, except where prohibited by law or where either party seeks injunctive relief. You waive the right to participate in class action lawsuits. EU consumers retain any mandatory rights provided under applicable EU consumer protection laws, which these Terms do not override.

13. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via in-app notice or email at least 14 days before taking effect. Continued use of cadence. after changes constitutes acceptance.
